{"id":28686,"date":"2018-11-12T09:00:40","date_gmt":"2018-11-12T09:00:40","guid":{"rendered":"https:\/\/jacothenorth.net\/blog\/?p=28686"},"modified":"2025-09-26T10:03:02","modified_gmt":"2025-09-26T09:03:02","slug":"corruption-in-the-wind","status":"publish","type":"post","link":"https:\/\/jacothenorth.net\/blog\/corruption-in-the-wind\/","title":{"rendered":"Corruption in the wind?"},"content":{"rendered":"<p><span style=\"font-size: 16px;\">People contact me regularly asking, <em>&#8216;Why don&#8217;t you write about wind energy, Jac, and about saving the planet, because we&#8217;re all doomed, doomed!&#8217;\u00a0<\/em>To which I usually respond, <em>&#8216;Sod off.&#8217;\u00a0<\/em>But one recent request to look into wind energy was different, and after an hour or so of digging I realised I just had to write about it.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Essentially, this is the story of three, linked, wind farms, but it&#8217;s also a reminder of how easy it is for political decisions in Wales to be controlled by those who care nothing for us or our country. Those I&#8217;m talking of see Wales as an exploitable resource, while we can be brushed aside with,\u00a0<em>&#8216;What&#8217;s it gotta do with you, Taff?&#8217;<\/em><\/span><\/p>\n<p><span style=\"font-size: 16px;\">Few things remind us more forcefully of this state of affairs than decisions concerning &#8216;the environment&#8217;.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Whether it&#8217;s allowing hippies to set up camp anywhere they like under the One Planet nonsense, encouraging &#8216;re-wilders&#8217; to force out Welsh farmers and take over vast swathes of our country, or allowing ugly wind turbines to produce their piddling amounts of electricity . . . but lots of money for those involved.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px; color: #ff0000;\"><strong>\u25ca<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\"><strong>THREE WIND FARMS<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\">Let&#8217;s start with Bryn Blaen wind farm near Llangurig, the village situated where the north-south A470 meets the A44 running down to Aberystwyth. Bryn Blaen was refused planning permission by Powys County Council, but the <a href=\"https:\/\/environment-analyst.com\/dis\/49347\/bryn-blaen-wind-farm-approved\">Planning Inspectorate overturned that decision<\/a>\u00a0in August 2016 and allowed the project to go ahead.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">So on this one, the developers got their way.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Next stop is Rhoscrowther, near Milford Haven in Pembrokeshire. This was turned down by Pembrokeshire County Council in 2015, the appeal by the developers was rejected by the Planning Inspectorate, but then a High Court judge said that it must be reviewed by a different planning inspector. It was, and in April this year she <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-wales-south-west-wales-43866583\">upheld the decision to refuse planning permission<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">This second refusal by the Planning Inspectorate was confirmed by Lesley Griffiths in <a href=\"https:\/\/drive.google.com\/file\/d\/14nxqbYBLOLBHhKkD8A-4LiO9bDNH7QZA\/view?usp=sharing\">a letter in May to the applicants&#8217; agents<\/a>. But the applicants made yet another appeal to the High Court, <a href=\"https:\/\/drive.google.com\/file\/d\/1v57-B-7GhnkOJoOG0JFhusMY969eOLJP\/view?usp=sharing\">which in September blocked any further appeal<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">That would appear to be the end of the Rhoscrowther wind farm.<\/span><\/p>\n<figure id=\"attachment_28698\" aria-describedby=\"caption-attachment-28698\" style=\"width: 400px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Hendy.jpg\" rel=\"lightbox\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-28698\" src=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Hendy.jpg\" alt=\"\" width=\"400\" height=\"248\" srcset=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Hendy.jpg 646w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Hendy-300x186.jpg 300w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Hendy-600x372.jpg 600w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Hendy-96x60.jpg 96w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><figcaption id=\"caption-attachment-28698\" class=\"wp-caption-text\">The vista that some want to mar with the Hendy wind farm, click to enlarge<\/figcaption><\/figure>\n<p><span style=\"font-size: 16px;\">Back to Powys, and\u00a0the Hendy wind farm, near Llandrindod. Planning permission was refused by Powys County Council in April 2017, and that decision was <a href=\"https:\/\/drive.google.com\/file\/d\/1lNvjC2degKAf62j7khSLfhuaaxna8qif\/view?usp=sharing\">upheld by a planning inspector in May<\/a> . . . but then, last month, Lesley Griffiths, Energy, Planning and Rural Affairs Secretary for the management team in Cardiff docks <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-wales-45991694\">said that she would ignore the planning inspector&#8217;s decision<\/a> and allow it to go ahead.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Such a move is unusual. The management team can certainly over-rule local authorities &#8211; as we&#8217;ve seen with the <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-wales-46083220\">latest developments in the Mumbles Pier project<\/a> &#8211; but to go against the Planning Inspectorate is unusual.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Here&#8217;s <a href=\"https:\/\/drive.google.com\/file\/d\/1SfIwX-ny2dQ9k1c72nE_sqpZM_IPSemj\/view?usp=sharing\">the letter Lesley Griffiths sent to Keith McKinney of Aaron and Partners LLP<\/a>, a firm of Chester solicitors acting for the developers. (You&#8217;ll note that there appears to have been some uncertainty over the date.)<\/span><\/p>\n<p><span style=\"font-size: 16px;\">In point 2 of the letter mention is made of the <a href=\"https:\/\/gov.wales\/topics\/planning\/developcontrol\/developments-of-national-significance\/?lang=en\">Developments of National Significance<\/a> legislation under which the &#8216;Welsh Ministers&#8217; have authority to rule on electricity generation projects with a maximum installed capacity between 10mw and 50mw. The three projects we&#8217;re looking at range from 12.5mw to 17.5mw.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Though according to the capture below from the <a href=\"https:\/\/gov.wales\/topics\/planning\/developcontrol\/developments-of-national-significance\/?lang=en\">&#8216;Welsh Government&#8217;s website<\/a>\u00a0the decision should be made by the Planning Inspectorate, which is what happened initially with Hendy, before Lesley Griffiths intervened.<\/span><\/p>\n<figure id=\"attachment_28756\" aria-describedby=\"caption-attachment-28756\" style=\"width: 400px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Developments-of-National-Significance.jpg\" rel=\"lightbox\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-28756\" src=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Developments-of-National-Significance.jpg\" alt=\"\" width=\"400\" height=\"94\" srcset=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Developments-of-National-Significance.jpg 585w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Developments-of-National-Significance-300x71.jpg 300w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Developments-of-National-Significance-96x23.jpg 96w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><figcaption id=\"caption-attachment-28756\" class=\"wp-caption-text\"><span style=\"font-size: 16px;\">click to enlarge<\/span><\/figcaption><\/figure>\n<p><span style=\"font-size: 16px;\">So who&#8217;s promoting these schemes, who are &#8216;the developers&#8217; I&#8217;ve referred to?<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px; color: #ff0000;\"><strong>\u25ca<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\"><strong>SLICES OF CAKE FOR EVERYONE!<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\">Each of these projects has its own company: <a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/07638774\">Bryn Blaen Wind Farm Ltd<\/a>, <a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/07638538\">Rhoscrowther Wind Farm Ltd<\/a> and <a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/07638660\">Hendy Wind Farm Ltd<\/a>. But all these companies have the same registered office address, 7a Howick Place, London SW1P 1DZ.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">A director of all three companies is Steven John Radford who seems to take another slice of the Welsh wind farm cake through his consultancy,\u00a0<a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/07619385\">Njord Energy Ltd<\/a>, which sounds comfortingly Scandinavian. (Though he obviously farmed out some work to <a href=\"https:\/\/www.cunnanetownplanning.co.uk\/fullscreen-page\/comp-j9skgezc\/f557888e-acd6-4bc0-96a7-fdb5d577c709\/3\/%3Fi%3D3%26p%3Dw3g99%26s%3Dstyle-jgdrlcch\">Cunnane Town Planning<\/a> of London and Manchester.)<\/span><\/p>\n<p><span style=\"font-size: 16px;\">In September Radford branched out again with\u00a0<a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/11580151\">Bute Energy Ltd<\/a>,\u00a0joining six days after its two founding directors. Bute Energy is in the electricity business, the production, transmission, distribution and trade of electricity to be exact. Will this be electricity generated in Wales?<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Also involved somewhere in these projects has been <a href=\"http:\/\/viento-env.co.uk\">Viento Environmental Ltd<\/a>,\u00a0of Shrewsbury, yet another consultancy, this one run by Fran Iribar, whose <a href=\"https:\/\/uk.linkedin.com\/in\/fran-iribar-3aab6213\">Linkedin profile<\/a> mentions the three wind farm sites we&#8217;re dealing with here plus a number of others in Wales.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 16px;\"><strong>Have you noticed yet? Three projects in Wales &#8211; no Welsh involvement whatsoever!<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\">What a system! You don&#8217;t need to be a nationalist to see how wrong this is. It&#8217;s basic economics.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Whatever their roles, Aaron and Partners of Chester, Viento of Shrewsbury, Njord and the rest, are all bit-part players, with everything being directed from London by the\u00a0<a href=\"http:\/\/www.uandiplc.com\">U and I Group plc<\/a>. Which was <a href=\"http:\/\/otp.investis.com\/clients\/uk\/u_and_i_group_plc\/rns\/regulatory-story.aspx?cid=1248&amp;newsid=1203316\">quick to celebrate Lesley Griffiths&#8217; intervention in the Hendy project<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">A curious beast, U and I. It was <a href=\"https:\/\/drive.google.com\/file\/d\/1GtuyXrl46o9G2sozScNsTAagJQUGG1-l\/view?usp=sharing\">known as Development Securities plc<\/a> until 5 November 2015. And on the very same day a previous incarnation of the <a href=\"https:\/\/drive.google.com\/file\/d\/1BWcP2ZLZ49-eULqTc6xlvNXcaRq3Nmbz\/view?usp=sharing\">U and I Group Ltd changed its name to Development Securities Ltd<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">We often come across shape-shifting and Lazarus-like resurrections on this blog. Think Paul and Rowena Williams, of Weep for Wales fame, with their Rural Retreats &amp; Leisure Ltd and Rural Retreats &amp; Leisure UK Ltd (which even confused an Employment Tribunal!); and recently, in <a href=\"https:\/\/jacothenorth.net\/blog\/wilmslow-sur-mer\/\">Wilmslow-sur-Me<\/a>r, we sobbed for Natural Retreats UK Ltd . . . only for it to be brought back to us by resurrectionists from <em>&#8216;Ol&#8217; Virginny&#8217;,<\/em> who just happen to be closely linked with those behind the expired company.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Offshore companies are also favoured by Marcus Owen Shepherd, Matthew Simon Weiner and Richard Upton, prominent figures in this deliberately confusing tangle of companies, but they&#8217;re not really offshore at all. Certainly that was the decision arrived at last year by HMRC which <a href=\"https:\/\/www.taxjournal.com\/articles\/development-securities-new-reality-company-residency-31082017\">concluded that Development Securities (No 9) was trying to pull a fast one<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">I&#8217;m sure you&#8217;re as shocked as I was to learn that there might be something underhand, dishonest even, about tax havens and offshore hideaways. Whatever next!<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Not only that, but U and I&#8217;s Welsh assets are already sold or up for sale. The panel below comes from the latest accounts (for y\/e 28.02.2018) of the group received by Companies House 01.08.2018. We now know that Hendy seems to be in the bag, but are they still holding out hopes for Rhoscrowther? Either way, how could they be so confident months ago? Did they know something we didn&#8217;t or was it just blind optimism linked to share prices?<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px; color: #ff0000;\"><strong>\u25ca<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\"><strong>MYSTERY WOMAN<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\">Back in 2017, on April 27 to be exact, there was a curious scene played out at a meeting of Powys County Council&#8217;s planning committee. At a point in the meeting after the committee had refused planning permission for Hendy and was about to discuss further conditions for Bryn Blaen, a woman who had been sitting with the developers tried to hand a note to one of the committee members.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">The woman had to be forcefully ushered away. She was recognised as a lobbyist, working for <a href=\"http:\/\/www.invictapa.co.uk\">Invicta Public Affairs<\/a>, a company based in Newcastle-upon-Tyne. The company is run by <a href=\"https:\/\/uk.linkedin.com\/in\/mark-cummings-a12b1538\">Mark Cummings,<\/a> who boasts, <em>&#8220;We specialise in advising private businesses how best to promote their commercial interests by overcoming barriers to enterprise caused by the UK national and devolved policy and regulatory framework.&#8221;<\/em><\/span><\/p>\n<p><span style=\"font-size: 16px;\">Cummings seems to operate in Wales through <a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/09631603\/filing-history\">Invicta Public Affairs (Wales) Ltd<\/a>, which has never been anything more than a name, with a Newcastle address, but clearly it has employees in Wales. So who was the mystery woman?<\/span><\/p>\n<p><span style=\"font-size: 16px;\">It was Anna McMorrin, who had been recruited by Invicta in October 2016 for no reason other than she was a Labour Party insider, having joined the party when she was a student, and as a result of her subsequent career she knew exactly who to approach to get things done.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">As her Wikipedia entry tells us, <em>&#8220;After graduating, McMorrin worked in public relations and communications. After working as a part-time communications officer for the Labour Party between 1996-1997, she worked for public affairs consultancy Hill and Knowlton. In 2006, McMorrin became Campaigns and Communications Director for\u00a0Friends of the Earth\u00a0Cymru. In 2008, she joined the\u00a0Welsh Government as an appointed Specialist Advisor, working with Ministers including\u00a0Jane Hutt\u00a0AM,\u00a0John Griffiths\u00a0AM and\u00a0Alun Davies\u00a0AM.&#8221;<\/em><\/span><\/p>\n<p><a href=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Davies-and-McMorrin.jpg\" rel=\"lightbox\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-28720 size-full\" src=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Davies-and-McMorrin.jpg\" alt=\"\" width=\"388\" height=\"281\" srcset=\"https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Davies-and-McMorrin.jpg 388w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Davies-and-McMorrin-300x217.jpg 300w, https:\/\/jacothenorth.net\/blog\/wp-content\/uploads\/2018\/11\/Davies-and-McMorrin-96x70.jpg 96w\" sizes=\"auto, (max-width: 388px) 100vw, 388px\" \/><\/a><\/p>\n<p><span style=\"font-size: 16px;\">While she was working for Alun Davies they began an affair which resulted in both leaving their long-term partners. They now live together.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">In the general election of June 2017 Anna McMorrin was elected Labour MP for Cardiff North.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px; color: #ff0000;\"><strong>\u25ca<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\"><strong>ANALYSIS<\/strong><\/span><\/p>\n<p><span style=\"font-size: 16px;\">U and I and\/or Development Securities planned three wind farms of a size so that even if the local planning committees voted against them then their bacon could be saved by the Planning Inspectorate or, as a last resort, the &#8216;Welsh Government&#8217;.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">To help them carry through this plan they employed Mark Cummings, useful for his expertise in dealing with devolved administrations. Cummings then needed someone who was a Labour insider, so he recruited Anna McMorrin.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">No doubt, the developers had hoped to get planning permission for all three developments, netting them as much as \u00a320 million. Being more realistic, they were probably prepared to settle for two out of three. But the High Court going against them on Rhoscrowther in September meant they were left with just Bryn Blaen, and so they were only going to make a small profit.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">The High Court couldn&#8217;t be challenged over Rhoscrowther so pressure was applied to Lesley Griffiths to overturn the Hendy decision. And she came good.<b><\/b><\/span><\/p>\n<p><span style=\"font-size: 16px;\">Who applied the pressure to Lesley Griffiths? Though this company seems to have been controlled by <a href=\"https:\/\/beta.companieshouse.gov.uk\/company\/06001931\">Brenig Wind Ltd<\/a>, a company run by Chinese citizens giving an address in France. The accounts are overdue at Companies House and I suspect we shall hear no more of Brenig Wind.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 16px;\">Though victory was claimed by <a href=\"https:\/\/www.power-technology.com\/news\/natural-power-secures-consent-pant-y-maens-onshore-wind-project\/\">Natural Power<\/a>, which has an <a href=\"https:\/\/uk.linkedin.com\/in\/john-woodruff-b97a3817\">office in Aberystwyth<\/a>.
